These Terms of Service (“Terms”) govern your access to and use of MKT1 MCP, including the MKT1 MCP Server and associated skills, agents, tools, frameworks, templates, and resources (collectively, “MKT1 MCP”).
By accessing or using MKT1 MCP, you agree to be bound by these Terms.
MKT1 MCP is operated by MKT1, LLC (“we,” “us,” “our”).
Some MKT1 MCP features are free. Full access requires a paid MKT1 Newsletter subscription and does not constitute a standalone software subscription unless otherwise specified.
Anyone who connects with an email address can use the free MKT1 MCP features. Full access requires a paid MKT1 Newsletter subscription.
Access is provided at our sole discretion and may be modified, suspended, or discontinued at any time without prior notice. Access does not constitute a guarantee of continued availability, and the features, functionality, and scope of MKT1 MCP may change at any time.
We may add, modify, or remove features, tools, or functionality of MKT1 MCP at any time.
Purchasing or maintaining a paid MKT1 Newsletter subscription, including an annual subscription, does not guarantee continued access to MKT1 MCP. Paid subscription fees, including annual subscription fees, are not refundable if access to MKT1 MCP is modified, suspended, or discontinued.
Paid MKT1 Newsletter subscriptions are purchased and billed through Substack or, where applicable, through our payment provider, Stripe, and are subject to the applicable provider’s terms, including its cancellation and refund policies. Access to MKT1 MCP is a benefit of that subscription and may change over time; its availability does not alter the price or terms of your subscription.
You must be at least eighteen (18) years of age to use MKT1 MCP.
Full access to MKT1 MCP requires:
You are responsible for maintaining your own third-party subscriptions.
Access to MKT1 MCP is personal and non-transferable. Free access is limited to the individual who owns the email address used to connect. Full access is limited to the individual whose email address is associated with an active paid MKT1 Newsletter subscription, including any seat on a group subscription. Each person must connect with their own email address, and you may not share full access with anyone else, including teammates.
You may connect only with an email address you own. You are responsible for all activity that occurs under your connection.
If you believe someone has connected using your email address, you must notify us promptly.
We may suspend or terminate accounts that appear to be shared, abused, or used in violation of these Terms.
You may use MKT1 MCP to apply MKT1, LLC’s marketing frameworks, tools, and resources to:
You may retain and use outputs generated through MKT1 MCP for your own internal or client business purposes, including consulting, strategy development, marketing execution, or similar professional work.

You may not use MKT1 MCP in a manner that places excessive load on our systems, interferes with the operation of the service, or attempts to bypass technical safeguards.
We reserve the right to implement rate limits, usage controls, monitoring, or technical protections necessary to maintain the reliability and security of MKT1 MCP.
We may suspend or terminate accounts that appear to engage in abusive, automated, or extraction-based usage patterns.
All content delivered through MKT1 MCP — including but not limited to marketing frameworks, strategic models, evaluation criteria, skill instructions, prompts, templates, and methodologies — is and remains the exclusive intellectual property of MKT1, LLC.
Nothing in these Terms grants you any ownership interest in MKT1, LLC’s intellectual property.
All rights not expressly granted in these Terms are reserved by MKT1, LLC.
Your inputs (such as company information, marketing materials, or strategic data) remain your property.
We claim no ownership of your inputs or the outputs generated for you through MKT1 MCP.
MKT1 MCP may operate through third-party AI platforms and is subject to the availability, performance, and policies of those platforms.
We are not responsible for any acts or omissions of third-party platform providers, including changes to their services, pricing, terms, functionality, or data handling practices.
Your use of third-party platforms is governed by their respective terms of service and privacy policies.
This Privacy Policy describes how MKT1, LLC collects, uses, and discloses personal information in connection with MKT1 MCP. MKT1, LLC, PO Box 438, Moultonborough, NH 03254, USA, is the controller of the personal information described in this Section.
Conversation Content
Your conversations are processed by the third-party AI platform you use (for example, Claude). When you invoke an MKT1 MCP tool, the AI platform transmits to the MKT1 MCP Server the inputs for that tool, such as a search term. MKT1 MCP tools are designed to request only the inputs necessary to perform the requested function, and we do not request or collect your broader conversation history. We use those inputs solely to fulfill the request. We do not store tool inputs in our databases, use them to train artificial intelligence models, or log the content of your conversations or AI-generated outputs. Search inputs submitted to MKT1 MCP search tools, including newsletter, LinkedIn, and template search, are transmitted to our hosting provider’s AI service solely to identify matching content and are not stored.
Information We Collect
Cookies
We use two first-party cookies on mcp.mkt1.co: (a) a cookie that records the link through which you installed MKT1 MCP, which expires after 30 days; and (b) a session cookie that keeps you signed in to the MKT1 perks page (the “Perk Stack”), which expires when you close your browser and is not accepted after 24 hours. We do not use advertising or third-party tracking cookies.
How We Use Information
We use the information described above to operate, secure, and improve MKT1 MCP; verify eligibility and access; provide support; understand the use of our skills and the effectiveness of our marketing channels; and communicate with you. When you connect to MKT1 MCP, we may add your email address to a Substack email list used solely for emails about MKT1 MCP, such as onboarding emails, new skills, and account updates. Connecting to MKT1 MCP does not subscribe you to the general MKT1 Newsletter. You may unsubscribe from marketing emails at any time.
How We Disclose Information
We disclose information to service providers that process it on our behalf to operate MKT1 MCP, including Cloudflare (hosting, security, and AI search), Airtable (subscriber and perks records), Substack (subscriptions and email) and Stripe (payments), Plain and Typeform (support), Anthropic (support request handling and subscription verification), Google (web fonts), and internal collaboration tools such as Slack, which may receive notifications that include your email address. We may also disclose information where required by law, to protect the rights, property, or safety of MKT1, LLC, our users, or others, or in connection with a merger, acquisition, or sale of all or part of our business. We do not sell personal information and do not use MKT1 MCP data for advertising purposes.
Data Retention
We retain personal information for as long as your account is active and thereafter for as long as reasonably necessary for the purposes described in this Privacy Policy, including to operate MKT1 MCP, comply with our legal obligations, resolve disputes, and enforce our agreements, unless you request its deletion. Usage analytics and link activity are retained for approximately ninety (90) days. Access tokens expire after twenty-four (24) hours. The authorization that permits your AI platform to obtain new access tokens remains in effect until you disconnect MKT1 MCP or we revoke it.
Security
We use reasonable administrative and technical measures to protect personal information, including encryption in transit and expiring access tokens. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
International Users
MKT1, LLC is based in the United States, and personal information is processed in the United States and in other countries where our service providers operate. Where required, we rely on appropriate safeguards, such as standard contractual clauses adopted by our service providers, for such transfers.
Do Not Track
Because we do not use advertising or third-party tracking cookies, we do not track users across third-party websites, and we therefore do not respond differently to Do Not Track or Global Privacy Control signals.
Children
MKT1 MCP is not directed to children, and we do not knowingly collect personal information from individuals under the age of eighteen (18). If we learn that we have collected such information, we will delete it.
Your Rights and Choices
You may disconnect MKT1 MCP from your AI platform at any time. Disconnecting stops further access but does not delete information we have already collected; to request deletion, contact us as described below. Depending on where you live, you may also have the right to request access to, correction of, deletion of, or a portable copy of your personal information, and to object to or restrict certain processing. You may exercise these rights by contacting us as described below. We will respond within thirty (30) days, or within any shorter period required by applicable law, and may need to verify your identity before doing so. You may designate an authorized agent to submit a request on your behalf. We will not discriminate against you for exercising any of these rights. If you are located in the European Economic Area or the United Kingdom, you may also lodge a complaint with your local data protection authority.

MKT1 MCP is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of:
We do not warrant that MKT1 MCP will be uninterrupted, error-free, secure, or free of harmful components, or that any outputs will be accurate, complete, or suitable for your purposes.
Outputs generated by AI systems may contain inaccuracies or incomplete information. You acknowledge that AI-generated outputs should be reviewed and validated before being relied upon for business decisions.
MKT1 MCP provides marketing frameworks and strategic resources only and does not constitute professional business, legal, financial, or tax advice.
You are solely responsible for evaluating and implementing any strategies, recommendations, or outputs.
To the maximum extent permitted by applicable law, MKT1, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity arising out of or related to your access to or use of MKT1 MCP.
In no event shall the total aggregate liability of MKT1, LLC for all claims arising out of or related to MKT1 MCP exceed the greater of (a) the amounts you have paid, directly or through Substack or any other payment platform, for your MKT1 Newsletter subscription in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
You agree not to access or use MKT1 MCP in violation of any applicable export control, trade sanction, or international trade laws.
You represent that you are not located in, or accessing MKT1 MCP from, a jurisdiction subject to sanctions that prohibit the use of such services.
We may modify these Terms, including the Privacy Policy in Section 9, from time to time by posting the updated version on this page and updating the Effective Date. If we make material changes, we will provide notice through the MKT1 MCP email updates or by email to the address associated with your account.
Your continued use of MKT1 MCP after the updated Terms take effect constitutes acceptance of the updated Terms.
We may suspend or terminate your access to MKT1 MCP at any time, with or without cause and with or without notice.
Upon termination, your right to access MKT1 MCP ceases immediately.
Sections 5, 7, 9, 10, 11, 14, 15, 16, and 17, and any other provisions that by their nature should survive, shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in the State of Delaware.
These Terms constitute the entire agreement between you and MKT1, LLC with respect to MKT1 MCP.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
MKT1, LLC may assign its rights and obligations under these Terms without restriction.
We welcome feedback regarding MKT1 MCP.
Any feedback, suggestions, or ideas you provide may be used by MKT1, LLC without obligation or compensation to you.
MKT1 MCP is provided with limited support. We are not able to respond to all support requests. We will prioritize responses to critical issues affecting access or security. Support requests must be submitted via our support form. We will not respond to support requests submitted via Substack comments or Substack DMs.
